Dear Mr. Werre:
Our Juneau office has just recently received an opinion from the Attorney
General's office stating that this Department has no legal authority to deny
the water system proposed for your subdivision. Our denial was based on your
failure to submit letters of non-objection from adjacent property owners. We
are, therefore, withdrawing our denial of your water system.
Enclosed with this letter is a copy of the Drinking Water Regulations (18 AAC
80). Section 100 of the regulations outlines our requirements pertaining to
review of public water system plans. Specifically, we will need the following
information before issuing the construction and operation certificate:
Engineered plans of the wellhouses, distribution system and any pro-
posed storage facilities. These plans must be approved by this
office prior to starting construction of the system improvements.
2. The results of raw water analyses for the inorganic chemical and
physical contaminants specified in 18 AAC 80.050.
We have already received copies of the well logs and the results of bacteriological
analyses of the well water so this information does not need to be resubmitted.
Upon receipt, we will review the plans and other information and issue our construc-
tion approval if major design problems are nonexistent.
Departmental approval of your water system will not relieve you of any liability
should the adjacent property owners seek compensation. We will continue to
recommend that you obtain their non-objection as a means of removing your lia-
bility.

In closing, I would like to point out that all on-site sewerage systems must
be approved by the Municipal Department of Health and Environmental Protection
prior to construction.
We will expedite our review of your plans upon their receipt.
