Maintenance, Repairs and Alterations. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. This includes an annual maintenance fee (typically $400 to $600). The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. When the Quanics system was installed (fall of 20 10) and a new drainfield installed, the discharge from the Quanics unit was ran through a diverter, and the old drainfield hooked up as a reserve system. During a recent adequacy test, it was discovered that the flow appears to never have been switched from the old drainfield, to the new drainfield. The old drainfield was approximately 75% full (down from being grossly surcharged in 2010), and the new drainfield was dry. During a recent conversation with Jay Crewdson from your department, it was mutually agreed upon that a 2000 gallons pre-soak of the 2010 system (150 sq.ft.) was not needed, as the drainfield appears to be un- used. GEG recently introduced a total of 1000 gallons (via water haul) into the 2010 drainfield, during which both monitoring tubes remained dry. Our justifications for utilizing our 1000 -gallon septic test of the 2010 drainfield are as follows: • The 2010 drainfield appears to be un -used since its installation, and remained dry during a 1000 gallons test (via water haul). • The old drainfield is actually recovering over time (due to the advanced treatment), despite that it appears to never have received a resting period. • The diverter valve is going to be switched so the flow is diverted to the 2010 drainfield. Any man-made or natural change in a system that would inhibit the system from performing as designed. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. Permit. An On -Site Wastewater Disposal Permit as required by AMC 15.65 to construct and operate an AWWTS. 3. Term. The term of this Maintenance and Repair Agreement shall begin on the date of approval by the Municipality to operate the installed system or issuance of a COSA, and shall continue while the AWWTS is in use or is operational or until the property is sold or title is transferred by the owner and a new COSA is issued to the new owner or transferee of the property. 4. Alterations. Installation and Removal of Additional Eauinment. Prior to performing any alterations to an AWWTS, the owner agrees to obtain an On-site Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65. 5. Maintenance and Repairs. A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall maintain their AWWTS in a satisfactory condition capable of producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. The owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the municipality and the manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it shall be the responsibility of the Owner during the term of this Maintenance and Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules and orders for the AWWTS. C. Upon request by the Municipality, the owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system. When a record of maintenance is documented and maintained by the system vendor, the owner agrees to allow the Municipality access to this information. D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60 for improper discharge. E. Owner agrees that only maintenance and repair personnel approved by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. F. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. G. Most tanks of this type typically have a structural life of approximately 20-25 years. No warrantee is made regarding the future life of the septic tank. D. SEPTIC SYSTEM ADEQUACY TEST: The drainfield is a 3 foot wide trench, which is 40 feet long, and has an effective depth of 10 feet (per the 1975 inspection report). On the day of the inspection (8/12/98), the liquid depth in the sump was 4.75 inches deep. Prior to starting the adequacy test, the 200 gallon hot tub was dumped into the septic system. Over a period of approximately 288 minutes, an additional 601 gallons was pumped into the septic system from the well. The level in the monitoring tube actually dropped . 5 inches throughout the test. Based upon this data, it was determined that the absorption rate of the trench exceeds 600 gallons per day, as required for a 4 bedroom house. NOTE: The adequacy of a septic system is influenced by numerous factors, including, but not limited to, seasonal surface water infiltration, groundwater variations, septic system maintenance (frequency of septic tank pumping, usage of biological additives), condition of drain pipe and pipe joints (which can be damaged by seismic activity and deteriorate with age), type of substances deposited in septic system (cigarette butts, sanitary napkins, misc. objects), and the amount of water being introduced on a continual basis. Consequently, the results of this adequacy test are only valid for the specific day of the test. Furthermore, because of the limited nature of this investigation, it is possible that there are hidden defects which may not have been detected. No warrantee is made regarding the future performance of this septic system E. SEPTIC SYSTEM IS ONLY ABOUT 75 FEET FROM SURFACE WATERS: Attached is a recent as -built survey which shows a stream/spring that runs through the property. Based upon the assumed location of the trench, and the documented 100 foot "stream" setback, it appears that the buried portion of the trench is as close as 75 feet from the water. The trench clean -outs appear to be as close as 87 feet. Also attached is a topography drawing which shows the direction that the lot slopes. It appears that any overflowing sewage could potentially flow towards the creek. However, in order for such an overflow to occur, the septic system would have to fail. Given the fact that the trench is over 23 years old, and operating with only 4.75 inches of liquid in it, is reasonable to assumed that an overflow is not likely to occur. In short, it appears that there is minimal risk associated with granting a waiver in this case. We are requesting that the subject separation distance be waived to 87 feet.
