Williams Our File No. 3836-1 Dear Mr. Weaver: I am writing on behalf of Glen V. Williams who would like to request a public hearing before the Platting Board in order to remove the requirement to build Hill Drive in the World Top Acres Subdivision. Mr. Williams believes that this requirement is no longer necessary because of the following: 1. Three of the four lots in the World Top Acres Subdivision have single family dwellings on them and are already accessible by road; Lots 3 and 4 via Hideaway Trail and Lot 2 by driveway from the previously existing Hill Drive. 2. Two of the four lots were released by the Munici- pality with no restrictions relating to the Hill Drive construc- tion. 3. The original Hill Drive right-of-way, which existed at the time of approval of the World Top Acres subdivi- sion, and extended through to upper O'Malley Road was vacated by the Municipality at the time the Hideaway Lake Subdivision was approved, cutting the primary projected access to Hill Drive. 4. The remaining Hill Drive right-of~way which borders Lots 1 and 2 of World Top Acres Subdivision is only a thirty foot right-of-way. Lot 1 is the only lot not currently accessed and the purchaser (who is out of state) of this lot assumed the responsibility as part of the purchase, for providing the driveway access to Lot 1 via this one-half right-of-way. 5. The 50% Hill Drive right-of-way dead ends at the northwest corner of Lot 1, World Top Acres Subdivision. Exten- Page 2 October 16, 1985 sion of the street beyond this point would now be impossible because of the creation of Hideaway Lake Subdivision. The property to the west of Lots 1 and 2 is undeveloped with no dedicated right-of-way for Hill Drive. This property is situated such that future development of the property would be through Hillside Drive. 6. Therefore, the requirement for development of the extension of Hill Drive by Lots 1 and 2 of World Top Acres Subdivision should be eliminated by the Municipality because: (a) Access to Lot 1 can be adequately provided via driveway and adequate right-of-way currently exists for development of a private driveway access to Lot 1, World Top Acres Subdivision. (b) The Hill Drive right-of-way which existed at the time of development of the World Top Acres Subdivision and which was to provide future primary access to the subdivision was vacated with the creation of the Hideaway Lake Subdivision without consideration for the location of World Top Acres Subdivision. (c) With the development that has already occurred within World Top Acres Subdivision, the development of Hideaway Lake Subdivision to the north, and access via Hillside Drive to the area west of Lot 1, World Top Acres Subdivision, no useful purpose would be served by this extension except as a punitive action on the part of the Municipality. The Subdivision case file number is S-3866 and the Subdivision Agreement was recorded on October 26, 1977 in Book 241 at Page 0289. Glen Williams Our File No. 3836-1 Dear Mr. Weaver and Ms. Contreras: APPLICATION FOR MODIFICATION OF AGREEMENT I am writing on behalf of Glen V. Williams who makes Application for Modification of S-3866, the Summary and Minutes of the Board Meeting of December 16, 1975. My client wishes to request a public hearing before the Platting Board in order to remove the requirement to build Hill Drive in the World Top Acres Subdivision to the west side of Lot 2 and instead to build a turn-around in the right-of-way on the west side of Lot 2 and grant a Public Use Easement on Lot 2 so that Lot 1 has road access. Mr. Williams believes that the requirement to build Hill Drive in full is no longer necessary because of the following: 1. The original Hill Drive right-of-way, which existed at the time of approval of the World Top Acres Subdivision, and extended through to upper O'Malley Road was vacated by the Municipality at the time the Hideaway Lake Subdivision was approved, cutting the primary projected access to Hill Drive. 2. (b) The Hill Drive right-of-way which existed at the time of development of the World Top Acres Subdivision and which was to provide future primary access to the subdivision was vacated with the creation of the Hideaway Lake Subdivision without consideration for the location of World Top Acres Subdivision. (c) With the development that has already occurred within World Top Acres Subdivision, the development of Hideaway Lake Subdivision to the north, and access via Hillside Drive to the area west of Lot 1, World Top Acres Subdivision, no useful purpose would be served by this extension except as a punitive action on the part of the Municipality.
