Dear Sirs:
We have reviewed the proposed vacation of a portion of the section
line easement through BLM Lot 204, Section ].8, T 14 N, R 1 W, SM.
Mr, Thibault stated that the Municipality was opposed to the vacation
unless the small triangle of land just South of Lot 204 was owned by
the State so that any future road coming from the West could swing
South and join Birchwood Loop at right angles.
The Department of Transportation does own the triangle and will allow
a road to go through it. However before the section line can be vacated
a specific portion of the section line easement will have to be dedicated
for such a road.
One other problem we see on the proposed subdivision is that the right
of way for Birchwood Road is not shown correctly. Our information
indicates the right of way is 50 foot from the center of the road.
This was established several years ago when the road was first paved.
