WATER EASEMENT
i4NOW ALL MEN BY THESE PRESENTS, that Robert C. Hughes and Mary c. Hughes
hereinafter called the GRANTOR $ , do_
hereby CONVEY to ANCHORAGE, a Municipal Corporation organized pursuant to the laws of
the State of Alaska, hereinafter called GRANTEE, an easement and a right of way in
Perpetuity, with the right, privilege and authority to ANCHORAGE, it's successors and
assigns, to construct, erect, operate and maintain water lines for the purpose of
supplying water through, across, over and under the following described real property,
to wit:
A parcel of land situated in Lot 128B of Patty Subdivision, a resubdivision of Govern-
ment Lot 128, Section 9, T. 15 N., R. l W., S.M., Alaska, being more particularly
described as follows:
Commencing at the southwest corner of said Lot 128B; thence N 89°29'40" E along the
south line of said lot, 67.42 feet to the POINT OF BEGINNING for this description;
thence leaving said south lot line N 15°08132" E, 46.25 feet; thence N 31008141" E,
132.79 feet to the east line of said lot; thence S 0036156" E along said east lot
line, 75.99 feet; thence leaving said east lot line S 31°08141" W, 52.55 feet; thence
S 15°08'32" W, 29.42 feet to said south lot line; thence S 89029'40" W along said
south lot line, 41.54 feet to the point of beginning.
Contains 5,420 square feet, more or less.
Reference Exhibit 'A' made a part hereof by reference.

necessary for the construction, reconstruction, alteration, operation, maintenance and
repair of said water lines and appurtenances, reservingunto the

a institution of any suit or preceding at law, at such times as may be necessary, to

obligation or liability therefor; provided that such work shall be accomplished in
such a manner that the private improvements existing in said easement area shall not
be disturbed or destroyed, or in the event that they are disturbed or destroyed they

was entered upon by GRANTEE; and provided that no building or buildings or other
permanent structures shall be constructed or permitted to remain within the boundaries
Of said easement without written permission of GRANTEE, it's successors or assigns.
This agreement shall be a covenant running with the land and shall be binding on
the GRANTORS heirs, executors, administrators and assigns forever.
