During our initial inspections of the tank and drainfield, the foundation was not installed. We performed our final grade and swing-tie inspection, after the foundation was installed and the building was framed and discovered that the cleanout for the first compartment was only 4'-7" away (edge of pipe to edge of visible footer). Based upon our assessment, it appears that the tank is slightly more than 3 feet from the footer; therefore, we are requesting a waiver to the code required 5 foot separation. The following is justification for the waiver: • Attached is profile drawing showing the encroachment, with an imaginary 45 degree angle of repose from the bottom of the footer. As can be seen this imaginary slope line intersects with the tank at the beginning of the first compartment. Even if the tank were moved 1'-10" further away from the foundation, so as to provide the required 5 foot separation, this imaginary line would still pass through the end of the tank. • Typically when septic tanks collapse, it occurs at top of the tank, between the end plates and the interior baffle With the encroachment being near the inlet of the tank, if it were to collapse, there is less chance that it would result in undermining of the foundation. • The new S.T.E.P. tank is made of 10 gauge thick steel, rated for deep burial. This should increase the life expectancy of the tank. • The new S.T.E.P. tank is in a very visible area and also is part of the advanced wastewater system that is required to be maintained annually. If the certified service provider notices a depression over the tank during his inspections, the tank integrity can be verified. In short, the tank area will be regularly observed by the service provider. Based upon these justification, it is our opinion that there is acceptable risk associated with the granting of this waiver. If you have any questions, please contact me at 337-6179. Please provide moro detail on the material for the dirt plug used to abandon part of the field partly located on this Int. - The undocumented drainfield is believed to be either a deep trench or perforated pipe laid on the porous gravel soils. Since we ara using a sand filter for this system, we are proposing that any portion of the undocumented drainfleld be removed, including any contaminated material, up to the property line and replaced with sand filter material. 3. Permit will not be issued until DEC waivers approved. - We have received one of the waivers from DEC and have attached a copy of the waiver approval. We ara still waiting on the other DEC waiver from the Drinking Department and anticipating it to be issued shortly. We will provide you a copy of the approval when we receive it. 4. The Well Decommissioning Log is to be submitted prior to Inspection Report approval. - A certified well service company will decommission the existing well. We will submit the well decommissioning log when we submit the Inspection Report. 5. The location of the possible undocumented septic system is unknown. We are proposing to install a Quanics Aerocell treatment system (CAT II) on this property which includes the installation of a 1500 gallon S.T.E.P. tank and 5-wide trench type drainfield. Attached are a site plan and a design drawing showing the proposed septic system. Two test holes were excavated on the property. The drainfield will be designed around the 30 foot radii of these test holes. There is an old agricultural well on the property that will be abandoned completely per the UPC code. A new well is to be drilled in the area as shown on the attached design drawing. Comments regarding the design are summarized as follows: 1. SOILS:' See the attached logs which show the soil classifications, groundwater monitoring, and the percolation test results. 2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications. 3. SURFACE WATERS: There are no surface water concerns. 4. TOPOGRAPHY: As can be seen on the attached site plan, the average topography around the proposed drainfield is relatively flat. In short, there are no slope concerns. 5. LOT LINE WAIVER: Due to site constraints, we are requesting a 5 foot lot line waiver from the west lot line and a 2 foot lot line waiver from the north lot line both to the proposed drainfield. 6. DRAINFIELD SEPARATION WAIVER: We are also requesting a 5 foot waiver from the proposed drainfield to the drainfield that serves the property to the west (Rebischke; Lot 50E). The drainfield on Lot 50E is an undocumented drainfield which never received a permit to construct nor was any as-builts or inspection report submitted. In consideration of the mutual covenants contained herein, the parties to this Maintenance and Repair Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. Municipality grants permission to Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as located at (legal description). 2. Definitions. Alteration. Any change to the design or function of an AWWTS that includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Certificate of On-Site Systems Approval (COSA). An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with Anchorage Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. Permit. An On-Site Wastewater Disposal Permit as required by AMC 15.65 to construct and operate an AWWTS. 3. Term. The term of this Maintenance and Repair Agreement shall begin on the date of approval by the Municipality to operate the installed system or issuance ora COSA, and shall continue while the AWWTS is in use or is operational or until the property is sold or title is transferred by the owner and a new COSA is issued to the new owner or transferee of the property. 4. Alterations~ Installation and Removal of Additional Equipment. Prior to performing any alterations to an AWWTS, the owner agrees to obtain an On-site Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65. 5. Maintenance and Repairs. A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall maintain their AWWTS in a satisfactory condition capable of producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. The owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the municipality and the manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it shall be the responsibility of the Owner during the term of this Maintenance and Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules and orders for the AWWTS. C. Upon request by the Municipality, the owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system. When a record of maintenance is documented and maintained by the system vendor, the owner agrees to allow the Municipality access to this information. D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60 for improper discharge. E. Owner agrees that only maintenance and repair personnel approved by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. F. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. G. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On-Site Systems Approval. H. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. 6. Nonwaiver. The failure of either party at any time to enforce a provision of this Maintenance and Repair Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Maintenance and Repair Agreement or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 7. Amendment. A. This Maintenance and Repair Agreement shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality that this Maintenance and Repair Agreement was executed with, and such writing shall be attached to this Maintenance and Repair Agreement as an amendment. B. For the purposes of any amendment modification or change to the terms and conditions of this agreement, the only authorized representatives of the parties are: a. Owner: b. The on-site wastewater disposal system to serve Lot 50F will be a Quaincs Category II advanced treatment system. The primary drainfield for this system will be outside of the reqmred 200' separa~on distance, however site consmUnts require the proposed reserve clrainfield area to be 190', at its nearest, away from the subject we]. Although the reserve drainfield is not constructed at tins rune, the Mumcipality of Anchorage as part of its review and approval, has required a Separation Distance Waiver from this office. This letter W~hter Demrmluatirm The PWS serving WHCS & UTDC was initially classified as a Community Pubhc Water System. In January 2009 it appears that the PWS was reclassified as Class C, however no formal designation was made at that time. Currendy, this department has received additional information and a fa.anal classification of the WHCS & UTDC PWS is ongoing. For a waiver of this type, as a conservative approach and to avoid possible future comphcations, the 200' mum separanon distance requirement for a Community, Non-Transient Non- Community, or Transient Non Community pubhc water system was used rather than the more liberal 150' requirement for a Class C system, 18 AAC 80.020 Table A. As enmnerated in your submittal, the following items were taken into consideration in reviewing this wmver: 1. The wastewater disposal system will be in a visible area and an overflow would be nodced and corrected immediately; 2. The effluent from the Qnanics Category II tank is treated and meets ADEC Secondary Standards; 3. The Quanics =eatment system is extmpped with an alarm and a remote monitoring system that alerts the owner and its service provider of an alarm condition, so that problems can be corrected immediately; 4. An existing wastewater disposal drxinfield which services Lot 50E crosses Ohm Lot 50F and currently encroaches upon ~e well with no apparent adverse effects. This portion of Lot 50E's wastewater disposal system will be removed and the proposed advanced treatment system to serve Lot 50F will greatly improve existing conditions; 5. The proposed septic system is m a well vegetated area and is down grade ofthe well; and 6. Recent water samples from the well show 1.6 mg/L of total nitrate/nitrite and the absence of E. call and total coliform bacteria.
