The Department has no objection to removing the plat note restricting access from Lot 3A to Rabbit Creek Road. The applicant has proven, to our satisfaction, the need to access Rabbit Creek Road. The legal description of this property is Lot 3A Karianne Hghts.. This Plat Note only effects Lot 3A. I have not made any changes or alterations to the property or any of the stuctures since this Plat Note was put on the property when it was replatted in 2001. The Plat Note was put on by the Department of Transportation. I have met with Sandra Cook (Area Planner) and Scott Thomas (P.E. Regional Traffic Engingeer) regarding the note. They have drafted a letter stating that the note may be removed. (See atteched document). The Plat Note refers to having acces to Rabbit Creek Road. The reason for removal of this Plat Note is that I am building a garage. Because of the current structure and design of the existing house the garage must be added to the North side of the house. The septic system does not allow acces to this garage from the original driveway. The driveway can not go around the East side of the home because there are existing structures and the Well which prohibit this. (See attached map). Thank you for you time and consideration.
