The ROW has the potential to provide access to the north end of Tracts 9,10A and 11, Iliamna Acres subdivision. Due to topographical considerations, remaining portions of Tract 11 and all of Tract 12 and beyond cannot be accessed from the ROW that begins at Buffalo Street, Grid SW3037. That remaining portion of Tract 11, all of Tract 12 and beyond must be accessed from East 142nd Avenue. As shown on the preliminary plat, it is also the intent of the owners of Tract 9 and Tract 10A Iliamna Acres subdivision to vacate the lot line between the north half of Tract 9 and Tract 10A to create Tract 9A. Access to the north end of Tract 11 where a single subdividable lot may be possible is provided through an access easement off East 142nd Avenue, also show on the preliminary plat. Ability to Vacate: 1. Is the Street or easement under control of MOA? Yes. It is a platted Right of Way, created 6/24/62. 2. Is the entire street or easement to be vacated, or is the remaining portion still usable? The developed portion of East 140"' Avenue ends at Buffalo Street, where it borders Tract 9 of Iliamna Acres subdivision. That portion of the Right of Way bordering the north end of Tracts 9 and 10A, Iliamna Acres is not developed. This is the portion of the ROW that is subject to this vacation request. The remaining portion of the designated El 40th ROW shall remain available for development. 3. Will the vacation landlock any adjacent parcels? Alternative access to one subdividable lot, which is not currently subdivided, is provided through an access easement identified on the preliminary plat. All remaining portions of the ROW known as East 140"' cannot be accessed from the Buffalo Street entry. The property line separating N'r4 Tract 9 and Tract 10A is to be vacated, creating one lot. There is one remaining subdividable portion of Tract 11 that can be accessed from an access easement entering off 142nd Avenue. The access easement is Included as part of this vacation of ROW and is Identified on the preliminary plat. Subdividable Vacation of ROW Page 2 of 2 portions of Tract 9 can be accessed from Buffalo Street or from the newly created access easement. Tracts 11 and 12, Iliamna Acres are undivided 5 -acre tracts, zoned R6 that may be subdividable. Due to topographical considerations, only the northern most subdividabie portion of Tract 11 can be accessed from the access easement entering off 142nd Avenue. The remaining portion of Tract 11 and all of Tract 12 must be accessed from other entry locations along East 142nd Avenue. 4. Is the street or easement designated on any long-range street or utility plan for future use? At this time, there are no known future plans for the development of 140"' Avenue beyond Buffalo Street. Certain wetlands issues impact the development of East 140", Avenue where it runs along Tract 9 and 10A. Key Points of General Discussion 1. Portions of Rabbit Creek enter into the ROW along that portion that borders Tract 9 and Tract 10A Iliamna Acres located on Grid SW3037, extending from Buffalo Street to Tract 11, Iliamna Acres. AMC 21.45.210 requires a stream protection setback of a minimum of 25 feet wide on either side of the stream. 2. Access to Tracts 12 Iliamna Acres and beyond cannot be made from Buffalo Street due to topographical reasons. 3. That subdividabie portion of the north end of tract 11 can be reached through an access easement entering from East 142nd Avenue. The remaining portion of Tract 11 must be accessed from East 142nd Avenue. I would like to discuss with you the reasons for this request. For background, the designated ROW in this request begins at the comer of Buffalo Street and East 14e Avenue. It extends along the northern borders of Tracts 9, 10A, 11 and 12 of Iliamna Acres. It terminates at the northeast comer of Tract 12. The tract of land bordering the north side of the ROW is municipal land known as Griffin Park. Rabbit Creek enters the ROW at two places within the area for which vacation is requested. The limits of the stream protection setback requirements of AMC 21.45.210 extend outside the ROW in those two places. A multipurpose trail through Griffin Park is included in the Areawide Trails Plan, April 1997. According to the Trails Plan, a multipurpose trail would enter the park at the southwest comer, extend through the middle of the park and exit at the northeast comer. The vacation request would not impact the development of this trail. Further, the vacation of this ROW will protect designated wetlands on the south side of Rabbit Creek that lie within Griffin Park. These low lying marshy lands serve as a natural habitat to indigenous mammals and birds. Note on the Preliminary Plat that a proposed access easement would provide access to subdividable portions of Tracts 10 or 11, Iliamna Acres. Due to topographical reasons, access would not be needed beyond Tract 11. VACATION OF RIGHT OF WAY OR EASEMENT N 50ft X 270ft Tract 9 and N 30ft X 300ft Tract 10A, Illamna Acres Submitted by Leland Little, Co -Owner of Tracts 9 and 10A, Iliamna Acres Item 9: Written Justification This request for Vacation of Right of Way is intended to remove a designation that is not part of any known long-range development plans of the Municipal of Anchorage and to protect wetlands created in two places where Rabbit Creek enters into the Right of Way (ROW). The ROW has the potential to provide access to the north end of Tracts 9, 10A and 11, Iliamna Acres subdivision. Due to topographical considerations, remaining portions of Tract 11 and all of Tract 12 and beyond cannot be accessed from the ROW that begins at Buffalo Street, Grid SW3037. That remaining portion of Tract 11, all of Tract 12 and beyond must be accessed from East 142n4 Avenue. As shown on the preliminary plat, it is also the intent of the owners of Tract 9 and Tract 10A Iliamna Acres subdivision to vacate the lot line between the north half of Tract 9 and Tract 10A to create Tract 9A. Access to the north end of Tract 11 where a single subdividable lot may be possible is provided through an access easement off East 142nd Avenue, also show on the preliminary plat. Ability to Vacate: 1. Is the Street or easement under control of MOA? Yes. It is a platted Right of Way, created 6124/62. 2. Is the entire street or easement to be vacated, or is the remaining portion still usable? The developed portion of East 140th Avenue ends at Buffalo Street, where it borders Tract 9 of Iliamna Acres subdivision. That portion of the Right of Way bordering the north end of Tracts 9 and 10A, Iliamna Acres is not developed. This Is the portion of the ROW that is subject to this vacation request. The remaining portion of the designated El 40th ROW shall remain available for development. 3. Will the vacation Iandiock any adjacent parcels? Alternative access to one subdividable lot, which is not currently subdivided, is provided through an access easement identified on the preliminary plat. All remaining portions of the ROW known as East 14dh cannot be accessed from the Buffalo Street entry. The property line separating N % Tract 9 and Tract 10A is to be vacated, creating one lot. There is one remaining subdividable portion of Tract 11 that can be accessed from an access easement entering off 142n4 Avenue. The access easement is included as part of this vacation of ROW and is identified on the preliminary plat. Tracts 11 and 12, Iliamna Acres are undivided 5 -acre tracts, zoned R6 that may be subdividable. Due to topographical considerations, only the northern most subdividable portion of Tract 11 can be accessed from the access easement entering off 142nd Avenue. The remaining portion of Tract 11 and all of Tract 12 must be accessed from other entry locations along East 142nd Avenue. 4. Is the street or easement designated on any long-range street or utility plan for future use? At this time, there are no known future plans for the development of 140"' Avenue beyond Buffalo Street. Certain wetlands issues impact the development of East 140"' Avenue where It runs along Tract 9 and 10A. Key Points of General Discussion 1. Portions of Rabbit Creek enter into the ROW along that portion that borders Tract 9 and Tract 10A Iliamna Acres located on Grid SW3037, extending from Buffalo Street to Tract 11, Iliamna Acres. AMC 21.45.210 requires a stream protection setback of a minimum of 25 feet wide on either side of the stream. 2. Access to Tracts 12 Iliamna Acres and beyond cannot be made from Buffalo Street due to topographical reasons. 3.
